TITLE VI INFORMATION

The Livermore Amador Valley Transit Authority (LAVTA) operates its services without regard to race, color and national origin in accordance with Title VI of the Civil Rights Act. Any person who believes she or he has been aggrieved by any unlawful discriminatory practice under Title VI may file a complaint with LAVTA.

A complainant may file a complaint directly with the Federal Transit Administration by filing a complaint with the Office of Civil Rights, Attention: Title VI Program Coordinator, East Building, 5th Floor-TCR, 1200 New Jersey Ave., SE, Washington, DC 20590

If you believe that you have received discriminatory treatment based on race, color or national origin with regard to transit services delivery; you have the right to file a Title VI complaint with the Authority’s Title VI Coordinator within one-hundred and eighty (180) calendar days of the last alleged incident. You may download a complaint form below or you may also call customer service and ask for a Title VI Complaint Form to be mailed to you. You may also submit a written statement that contains all the information listed below.

All complaints should include the following information:
- Name, address and telephone number of the complainant.
- The basis of the complaint; (e.g, race, color, or national origin).
- The date(s) on which the alleged discriminatory event occurred.
- The nature of the incident that led the complainant to feel discrimination was a factor.
- Names, addresses and telephone numbers of persons who may have knowledge of the event.
- Other agencies or courts where the complaint may have been filed and a contact name.
Verbal complaints will be accepted and transcribed by the Title VI Coordinator. To make a verbal complaint, call 925-455-7500 and ask for the Title VI Coordinator.
You also have the right to file a complaint with an external entity such as the Federal Transit Administration (FTA) or a federal or state court. A complainant may file a complaint directly with the Federal Transit Administration by filing a complaint with the

Should a complaint be filed with LAVTA and an external entity simultaneously, the external complaint shall supersede the LAVTA complaint and LAVTA’s complaint procedures will be suspended pending the external entity’s findings.
Within 10 working days of receipt of the formal complaint, the Title VI Coordinator will notify the complainant and begin an investigation (unless the complaint is filed with an external entity first or simultaneously).
The investigation will address complaints against any LAVTA department(s). The investigation will be conducted in conjunction with and under the advice of LAVTA’s third party claims adjuster.
The investigation may include discussion(s) of the complaint with all affected parties to determine the nature of the problem. The complainant may be represented by an attorney or other representative of his/her own choosing and may bring witnesses and present testimony and evidence in the course of the investigation.
The investigation will be conducted and completed within 60 days of the receipt of the formal complaint.
Based upon all the information received, an investigation report will be written by the Third Party Claims Adjuster for submittal to the Executive Director.
The complainant will receive a letter stating the final decision of the Executive Director by the end of the 60-day time limit.
The complainant shall be notified of his/her right to appeal the decision to LAVTA or the FTA.
